Definitions

Our privacy policy should be simple and understandable for everyone. For this reason, our privacy policy generally uses the official terms of the General Data Protection Regulation (GDPR). The official definitions are explained in Art. 4 GDPR.

Web Hosting

This website is hosted by an external service provider (hoster). This website is hosted in Germany. Personal data collected on this website is stored on the hoster's servers. This may include, but is not limited to, IP addresses, contact requests, meta and communication data, web page accesses and other data generated by a website.

We have concluded a Data Processing Agreement with the provider in accordance with the requirements of Art. 28 GDPR, in which we commit him to protect the data of our customers and not to pass them on to third parties.

Cookies

Our website uses so-called “cookies”. Cookies are small text files that are either temporarily stored on your end device for the duration of a session (session cookies) or permanently (permanent cookies). Adobe Typekit

This site uses so called web fonts, provided by Adobe Typekit, for the consistent display of fonts. Adobe Typekit is a service provided by Adobe Systems Software Ireland Ltd. When you access a page, your browser loads the required web fonts into your browser cache to display text and fonts correctly.

For this purpose, the browser you use must connect to Adobe's servers in the U.S. This allows Adobe Typekit to know that your IP address is being used to access our website.

Our website uses Google Analytics, an internet analysis service provided by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland ("Google"). Google Analytics uses so-called "cookies" and web beacons.

The data will be deleted as soon as it is no longer necessary for the purpose for which it was collected. Data Transfer and Recipients

Your personal data is not transferred to third parties, unless
– we have explicitly pointed this out in the description of the respective data processing.

– the transfer pursuant to Art. 6 para. 1 sentence 1 lit. f GDPR is necessary for the assertion, exercise or defence of legal claims and our legitimate interests are not overridden by your fundamental rights and freedoms.

In addition, we use external service providers for the processing of our services, whom we have carefully selected and commissioned in writing. They are bound by our instructions and are regularly monitored by us. Required data processing agreements pursuant to Art. 28 GDPR are concluded before the commission. In particular, these contracts concern web hosting services, the dispatch of emails and IT updates and maintenance. Your personal data will not be transferred to third parties by our service providers.

Newsletter CleverReach

If you would like to receive the newsletter offered on our website with regular information about our offers and products, we need your email address as mandatory information.

Additional data is provided in order to address you personally in the newsletter and/or to identify you if you wish to exercise your rights as a data subject.

For the dispatch of the newsletter we use the so-called double opt-in. This means that we will only send you our newsletter via email, if you have expressly confirmed that you agree to receive newsletters. In the first step, you will receive an email with a link to confirm that you, as the owner of the corresponding email address, wish to receive newsletters in the future. With the confirmation you give us your consent in accordance with Art. 6 para. 1 lit. a GDPR that we may use your personal data for the purpose of the desired newsletter dispatch.

When you register for the newsletter, in addition to the email address required for sending the newsletter, we store the IP address by which you registered for the newsletter as well as the date and time of registration and confirmation in order to be able to trace possible misuse at a later point in time.

You can unsubscribe from the newsletter at any time by clicking on the link included in each newsletter or by sending an email to the controller as described above. Once you have cancelled your subscription, your email address will be deleted from our newsletter list immediately, unless you have expressly consented to the continued use of the data collected.

Our email newsletters are sent via a technical service provider to whom we pass on the data you provide when you register for the newsletter. We have concluded a data processing agreement with our e-mail service provider in which we bind him to protect the data of our customers and not to pass them on to third parties.

Our provider uses this information for the dispatch and statistical evaluation of the newsletter on our behalf. For the evaluation the sent emails contain so-called web beacons or tracking pixels, which are one-pixel image files stored on our website. In this way it can be determined whether a newsletter message has been opened and which links have been clicked on, if applicable. Conversion tracking can also be used to analyse whether a predefined action (e.g. purchase of a product on our website) was carried out after clicking on the link in the newsletter. Technical information is also recorded (e.g. time of access, IP address, browser type and operating system). The data is collected pseudonymously and is not linked to your other personal data, a direct personal reference is excluded. These data are used exclusively for statistical analysis of newsletter campaigns. The results of these analyses can be used to better adapt future newsletters to the interests of the recipients.

If you wish to object to the data analysis for statistical evaluation purposes, you must cancel the newsletter subscription.

Contact by email

If you send us requests via email, your details you have provided there, will be stored for the purpose of processing your request and in the event of follow-up questions. Under no circumstances will we pass on this data without your consent. The legal basis for processing the data is our legitimate interest in responding to your request pursuant to Art. 6 para. 1 lit. f GDPR and, if applicable, Art. 6 para. 1 lit. b GDPR, provided that your request is aimed at concluding a contract. Your data will be deleted after final processing of your request, provided that there are no legal storage obligations to the contrary. You can object to the processing of your personal data at any time in the case of Art. 6 para. 1 lit. f GDPR.

Live-Chat Zendesk

On our website we use the Zendesk Chat, a live chat software from the US company Zendesk, Inc, 1019 Market Street San Francisco, CA 94103, which processes and documents the messages and data received via the live chat. The Zendesk chat is used for the purpose of direct communication in real time (so-called live chat) with visitors to their own website.

When you use our live chat system, the data you provide will be stored to answer your questions. The data collected includes

It is possible to record contact details such as name, telephone number and e-mail address to facilitate contact. These data will not be passed on to third parties and are only used to process and document enquiries.

As a transfer of personal data to the USA takes place, further protective mechanisms are required to ensure the level of data protection provided for by the GDPR. In order to guarantee this, we have agreed standard data protection clauses with the provider in accordance with Art. 46 Para. 2 lit. c GDPR. These clauses oblige the recipient of the data in the USA to process the data in accordance with the level of protection in Europe. In cases in which this cannot be guaranteed even by this contractual extension, we will endeavour to obtain additional regulations and commitments from the recipient in the USA.

Any chats that are conducted are logged there and stored for as long as is necessary to answer your query. Afterwards the data provided will be deleted, unless you wish otherwise.

The processing is carried out on the basis of article 6 paragraph 1 letter f GDPR in accordance with our legitimate interest in direct and customer-friendly communication. If the chat messages are aimed at the conclusion of a contract, the processing is based on the initiation of a contract in accordance with Art. 6 Para. 1 lit. b GDPR.

YouTube

On our website we embed videos from "YouTube", a social media platform of Google Ireland Limited, Google Building Gordon House, Barrow St, Dublin 4, Ireland (hereinafter referred to as "Google"). The legal basis for the processing of your personal data is your given consent according to Art. 6 para. 1 s. 1 lit. a GDPR.
By using the service, personal data is transferred to the U.S. The legal basis for the transfer of your personal data to the U.S. is your consent in accordance with Art. 49 para. 1 s. 1 lit. a GDPR. Please note that such transfers of personal data without an adequacy decision and appropriate safeguards pose a risk to you. The risk is that due to legislation in the U.S., the personal data may be accessed by American authorities (in particular the intelligence services). Legal protection options or information on the handling of your data by the U.S. authorities are only possible to a very limited extent or not at all. A level of data protection in accordance with the regulations of the GDPR can therefore not be ensured.

If the display of the embedded YouTube videos is started by your consent, the provider "YouTube" uses cookies to collect information about user behaviour. According to information from "YouTube", these serve, among other things, to collect video statistics, improve user-friendliness and prevent abusive behaviour. If you are logged in to Google, your information is associated directly with your account when you click on a video. If you do not want your profile to be associated with YouTube, you must log out before activating the button. Google stores this data as user profiles and uses them for the purposes of advertising, market research and/or demand-oriented design of its websites. Such an evaluation is carried out in particular (also for users who are not logged in) for the purpose of presenting need-based advertising and to inform other users of the social network about your activities on our website. Storage period

The period for which the personal data will be stored is determined by the relevant statutory storage periods (e.g. from commercial law and tax law). The corresponding data is deleted routinely upon expiry of the respective period. If data is required for the fulfilment of a contract or contract initiation, or if we have a legitimate interest in further storage, the data will be deleted if they are no longer required for these purposes or if you make use of your right of withdrawal or objection.

In the following, you will find information about your data subject rights, which the current data protection law grants you against the controller concerning the processing of personal data:

The right, pursuant to Art. 15GDPR, to obtain information about your personal data processed by us. In particular, you may request information about the purposes of processing, the categories of personal data concerned, the categories of recipients to whom your data has been or will be disclosed, the envisaged period for which the data will be stored, the existence of the right to request from the controller rectification or erasure or personal data or restriction of processing of personal data concerning you or to object such processing, the existence of a right to lodge a complaint with a supervisory authority, the origin of your data, if these have not been collected by us, and the existence of automated decision-making including profiling and, if applicable, meaningful information about the logic involved, as well as the significance and the envisaged consequences.

The right to obtain without undue delay the rectification of inaccurate personal data concerning you. in accordance with Art. 16 GDPR.

The right to request the erasure of your personal data stored by us in accordance with Art. 17 GDPR, unless the processing is necessary to exercise the right of freedom of expression and information, to fulfil a legal obligation, for reasons of public interest or to assert, exercise or defend legal claims.

The right, pursuant to Art. 18 GDPR, to demand the restriction of the processing of your personal data if the accuracy of the data is contested by you, the processing is unlawful, but you oppose the erasure and we no longer need the data for the purposes of processing, but they are required by you for the establishment, exercise or defence of legal claims or you have filed an objection against the processing pursuant to Art. 21 GDPR.

The right, in accordance with Art. 20 GDPR, to receive the personal data concerning you, which you have provided to us in in a commonly used and machine-readable format and the right to transmit those data to another controller.

The right to withdraw your given consent pursuant to Art. 7 para. 3 GDPR with effect in the future at any time.
The right to lodge a complaint with a supervisory authority pursuant to Art. 77 GDPR, in particular in the Member State of your habitual residence, place of work.

The right to withdraw your given consent pursuant to Art. 7 para. 3 GDPR: You have the right to withdraw your given consent concerning the processing of your personal data with effect for the future at any time. In the event of withdrawal, we will delete the data concerned without delay, unless further processing can be based on a legal basis for processing without consent. The withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal

Right to object

If your personal data is processed by us based on legitimate interests pursuant to Art. 6 para. 1 lit. f GDPR, you have the right, pursuant to Art. 21 GDPR, to object at any time to the processing of your personal data on grounds relating to your particular situation. If the objection is directed against the processing of personal data for the purpose of direct marketing, you have a general right of objection without the requirement of stating a particular situation.

Terms of Use

1. Geltungsbereich


1.1 Diese allgemeinen Nutzungsbedingungen gelten für Inanspruchnahme der Dienste der OffBlock GmbH, Haller Straße 187, 74564 Crailsheim (nachfolgend „OffBlock GmbH“) durch den Nutzer/die Nutzerin (nachfolgend „Nutzer“).

1.2 Für diese Vertragsbeziehung zwischen OffBlock GmbH und dem Nutzer gelten ausschließlich die nachfolgenden Allgemeinen Geschäftsbedingungen in ihrer zum Zeitpunkt des Vertragsschlusses gültigen Fassung. Abweichende Bedingungen des Nutzers erkennt OffBlock GmbH nicht an, es sei denn, OffBlock GmbH hat ausdrücklich ihrer Geltung zugestimmt.

1.3 OffBlock GmbH kann diese allgemeinen Nutzungsbedingungen nachträglich ändern. In einem solchen Fall wird OffBlock GmbH die geänderten Bedingungen mitteilen und die Änderungen deutlich hervorheben. Wenn der Nutzer mit diesen Änderungen nicht einverstanden ist, kann er innerhalb von sechs Wochen nach Zugang der Änderungsmitteilung widersprechen. Erfolgt in dieser Zeit kein Widerspruch, gelten die Änderungen als genehmigt. Im Falle des Widerspruchs gilt der Vertrag unverändert weiter, allerdings wird OffBlock GmbH ggf. von seinem ordentlichen Kündigungsrecht Gebrauch machen. OffBlock GmbH wird auf das Widerspruchsrecht, die Bedeutung des Nutzerverhaltens und auf die resultierenden Rechtsfolgen in der Mitteilung besonders hinweisen.

2. Allgemeine Leistungsbeschreibung


2.1 OffBlock GmbH stellt seinen Nutzern eine Softwarelösung zur Auswertung und Protokollierung von Dienstplänen, insbesondere die von Fluggesellschaften ausgegebenen Dienstpläne, im Rahmen der in Ziff. 9 genannten Verfügbarkeit, zur Verfügung. Die Software steht dem Nutzer im Apple App Store zum Download zur Verfügung.

2.2 Die Software liest dabei sämtliche Daten aus dem Dienstplan aus, unterscheidet anhand von Dienstcodes Flüge oder andere Dienste (wie Seminare, Bürodienste, Simulator-Einsätze, Krankheit, Standby, Training, Medizinische Untersuchungen etc.) und stellt diesen in einem leicht lesbaren Format dar. 2.3 Sein Nutzerkonto kann der Nutzer über ein Login mit Benutzername und Passwort einsehen. Dort hat der Nutzer auch unter anderem die Möglichkeit, seine persönlichen Daten zu aktualisieren.

2.4 OffBlock GmbH ist bei kostenlosen Features berechtigt, diese nach billigem Ermessen zu ändern, soweit dies für den Nutzer nicht unzumutbar ist oder kann Leistungen unter Beachtung der Kündigungsfristen einstellen.

3. Nutzungsvoraussetzungen


3.1 Zur Nutzung der Software muss sich der Nutzer zunächst unentgeltlich bei OffBlock GmbH registrieren. Nach dem Überspielen seiner Dienstpläne auf den von OffBlock GmbH genutzten Server kann der Nutzer die kostenpflichtige Analyse seiner Dienstpläne vornehmen lassen (Dienst).

3.2 Zur Nutzung der Software benötigt der Nutzer einen Internetzugang sowie ein zeitgemäßes iOS-fähiges Gerät (z. B. iPhone, iPad, iPod). Die Nutzung über ältere Betriebssystemversionen kann eingeschränkt sein.

4. Kosten, Werbung


4.1 Für die Registrierung selbst erhebt OffBlock GmbH keine Kosten.

4.2 Die Nutzung der Softwarepakete „OffBlock Pro“ und „OffBlock Pro+“ ist hingegen kostenpflichtig. Die Preise werden dem Nutzer im Einzelnen im Rahmen des Bestellvorgangs angezeigt. Abonnements verlängern sich automatisch, wenn sie nicht innerhalb von 24 Stunden vor Ablauf der aktuellen Dauer über den iTunes-Account des Nutzers beendet werden.

4.3 Bei der Nutzung entstehen dem Nutzer ggf. Verbindungskosten, die von dem jeweiligen Mobilfunkvertrag des Nutzers oder etwaigen sonstigen Verträgen abhängig sind und daher nicht Gegenstand dieser Bedingungen sein können.

4.4 Der Nutzer erklärt sich auch zum Erhalt von in OffBlock befindlicher Werbung auf seinem Endgerät bereit.

5. Vertragsschluss


5.1 Das Zustandekommen des Vertrages zwischen dem Nutzer und OffBlock GmbH über die Nutzung der Software wird nachfolgend beschrieben.

5.2 Registrierung: Der Nutzer muss zur Registrierung nach dem App-Start zumindest die angegebenen Pflichtfelder des Formulars auszufüllen. Die angegebene E-Mailadresse stellt dabei den Benutzernamen dar und kann frei gewählt werden. Eingaben in dem Formular kann der Nutzer bis zu deren Abschicken jederzeit korrigieren, ändern und löschen. Mit dem Klick auf das Feld „registrieren“ gibt der Nutzer einen bindenden Antrag über die Registrierung bei OffBlock GmbH ab. Auf diesen Antrag erhält der Nutzer eine automatisch generierte Bestätigungs-E-Mail zu der von ihm eingetragenen E-Mailadresse. Mit dem Akzeptieren des ersten Logins nimmt OffBlock GmbH das Angebot an.

5.3 Nutzung von OffBlock: Zur Durchführung der Analyse der Dienstpläne muss der Nutzer diese auf den von OffBlock GmbH genutzten Server überspielen oder seine Dienste manuell eintragen. Erst die Nutzung der hinterlegten Abonnements ist für den Nutzer kostenpflichtig. Diese Abonnements können über den Apple App Store mittels eines iTunes-Accounts gebucht und über das dort hinterlegte Zahlungsmittel (z. B. Kreditkarte) bezahlt werden.

5.4 Vor der Registrierung können diese Allgemeinen Nutzungsbedingungen durch einen direkten Link aufgerufen werden. Abgesehen von den Nutzungsbedingungen wird kein Vertragstext gespeichert.

5.5 Der Vertragsschluss über die Registrierung bei OffBlock GmbH sowie die Nutzung von OffBlock erfolgt in deutscher Sprache.

6. Widerrufsbelehrung


6.1 Widerrufsrecht: Sie können Ihre Vertragserklärung innerhalb von 14 Tagen ohne Angabe von Gründen in Textform (z.B. Brief, Fax, E-Mail) widerrufen. Die Frist beginnt nach Erhalt dieser Belehrung in Textform, jedoch nicht vor Vertragsschluss und auch nicht vor Erfüllung unserer Informationspflichten gemäß Artikel 246 § 2 in Verbindung mit § 1 Abs. 1 und 2 EGBGB sowie unserer Pflichten gemäß § 312e Abs. 1 Satz 1 BGB in Verbindung mit Artikel 246 § 3 EGBGB. 6.2 Widerrufsfolgen: Im Falle eines wirksamen Widerrufs sind die beiderseits empfangenen Leistungen zurückzugewähren und ggf. gezogene Nutzungen (z.B. Zinsen) herauszugeben. Können Sie uns die empfangene Leistung ganz oder teilweise nicht oder nur in verschlechtertem Zustand zurückgewähren, müssen Sie uns insoweit ggf. Wertersatz leisten. Dies kann dazu führen, dass Sie die vertraglichen Zahlungsverpflichtungen für den Zeitraum bis zum Widerruf gleichwohl erfüllen müssen. Verpflichtungen zur Erstattung von Zahlungen müssen innerhalb von 30 Tagen erfüllt werden. Die Frist beginnt für Sie mit der Absendung Ihrer Widerrufserklärung, für uns mit deren Empfang.

6.3 Besonderer Hinweis: Ihr Widerrufsrecht erlischt vorzeitig, wenn der Vertrag von beiden Seiten auf Ihren ausdrücklichen Wunsch vollständig erfüllt ist, bevor Sie Ihr Widerrufsrecht ausgeübt haben.

7. Rechteeinräumung


7.1 Dem Nutzer wird ein einfaches (nicht-exklusives), nicht übertragbares, nicht unterlizenzierbares und widerrufliches Nutzungsrecht OffBlock eingeräumt, dieses mittels iOS-Gerät von OffBlock GmbH zu nutzen. Die Anfertigungen von innerhalb von OffBlock vorgesehenen Ausdrucken (z.B. im .pdf-Format) ist zulässig.

7.2 Die wiederholte Auswertung von (geänderten) Einträgen für ein jeweiliges Kalenderjahr ist unbeschränkt.

7.3 Der Nutzer ist insbesondere nicht berechtigt, die App selbst zu bearbeiten, Änderungen hieran vorzunehmen oder derivative Werke zu erstellen. Gleiches gilt für Reverse Engineering, Dekompilierung und Disassemblierung der Software. Abweichende zwingende gesetzliche Vorschriften bleiben hiervon unberührt.

8. Laufzeit und Kündigung


8.1 Der Vertrag über die Registrierung bei OffBlock GmbH sowie die Nutzung der Software wird auf unbestimmte Zeit geschlossen. Der Nutzer kann den Vertrag jederzeit ohne Angabe von Gründen schriftlich beenden oder sein Konto innerhalb der Software unwiderruflich löschen.

8.2 OffBlock GmbH kann den Vertrag jederzeit ordentlich mit einer Frist von einem Monat kündigen.
Das Recht beider Parteien zur Kündigung aus wichtigem Grund bleibt unberührt. Ein wichtiger Grund liegt für OffBlock GmbH insbesondere vor, wenn der Nutzer gegen diese Nutzungsbedingungen nicht nur unerheblich oder mehrfach verstößt.

8.3 Mit Wirksamwerden der Kündigung erlischt das Recht des Nutzers, die Software bzw. sein Nutzerkonto weiterhin zu nutzen.

9. Verfügbarkeit


9.1 Die Software steht dem Nutzer im Monatsmittel im Rahmen der technischen und betrieblichen Möglichkeiten mit einer Verfügbarkeit von 98,0 % im Monatsmittel bereit. Davon ausgenommen sind Störungen, die außerhalb des Betriebes von OffBlock GmbH entstehen, z.B. durch Unwetter, Internetstörungen sowie die aufgrund von zuvor angekündigten Wartungsfenstern entstehenden Nichtverfügbarkeiten.

9.2 OffBlock GmbH ist dennoch bemüht, den Zugang zur Software allen Nutzern 24 Stunden täglich und 7 Tage pro Woche zur Verfügung zu stellen. Vorübergehende Betriebsunterbrechungen aufgrund der üblichen Wartungsarbeiten, systemimmanenten Störungen des Internet bei fremden Providern oder bei fremden Netzbetreibern sowie im Falle höherer Gewalt sind allerdings möglich. Der Nutzer hat deshalb keinen Anspruch auf eine jederzeitige, ununterbrochene Zugänglichkeit der Software.

9.3 Im Bereich Mobilfunk und Internet ist eine störungsfreie Leistungserbringung nicht möglich. OffBlock GmbH steht insbesondere nicht für die ständige Verfügbarkeit seiner technischen Systeme oder die Vollständigkeit, Richtigkeit oder Aktualität der dem Nutzer zur Verfügung gestellten Informationen oder für Fehler in der Datenübertragung.

10. Haftung


10.1 OffBlock GmbH haftet uneingeschränkt nach Maßgabe der gesetzlichen Bestimmungen für Schäden des Nutzers, die durch vorsätzliches oder grob fahrlässiges Verhalten von OffBlock GmbH oder seiner Erfüllungsgehilfen verursacht worden sind sowie für Personenschäden und Schäden nach dem Produkthaftungsgesetz.

10.2 Im Übrigen ist die Haftung von OffBlock GmbH für Schadensersatzansprüche – gleich aus welchem Rechtsgrund – nach Maßgabe der folgenden Bestimmungen beschränkt, soweit sich nicht aus einer von OffBlock GmbH übernommenen Garantie etwas anderes ergibt:

10.2.1 Für leicht fahrlässig verursachte Schäden haftet OffBlock GmbH nur, soweit sie auf der Verletzung vertragswesentlicher Pflichten (Kardinalpflichten) beruhen. Kardinalpflichten sind solche Vertragspflichten, deren Erfüllung die ordnungsgemäße Durchführung des Vertrages überhaupt erst ermöglichen und auf deren Einhaltung der Nutzer vertrauen durfte. Soweit OffBlock GmbH hiernach für einfache Fahrlässigkeit haftet, ist die Haftung von OffBlock GmbH auf den typischerweise vorhersehbaren Schaden beschränkt.

10.2.2 Die Haftung von OffBlock GmbH für den von OffBlock GmbH leicht fahrlässig verursachten Verlust von Daten und/oder Programmen ist auf den typischen Wiederherstellungsaufwand beschränkt, der bei regelmäßiger und den Umständen nach angemessener Datensicherung durch den Nutzer angefallen wäre.

10.3 Die Bestimmungen der vorstehenden Absätze gelten entsprechend auch für eine Begrenzung der Ersatzpflicht für vergebliche Aufwendungen (§ 284 BGB).

10.4 Die vorstehenden Haftungsbeschränkungen gelten auch zugunsten von Erfüllungsgehilfen von OffBlock GmbH.

10.5 Für bei Beginn der Leistungsbereitstellung vorhandene Fehlfunktionen der Software haftet OffBlock GmbH nur, wenn OffBlock GmbH diese aufgrund seines oder dasjenige seiner Erfüllungsgehilfen zu vertreten hat.

11. Datenschutz


11.1 Der Betrieb einer interaktiven Software basiert auf dem Austausch und der Veröffentlichung von Informationen, Nachrichten und Daten der Nutzer. Jeder Nutzer kann frei entscheiden, welche Informationen er außer seinem Benutzernamen anderen Nutzern zugänglich machen möchte. Eine Vertraulichkeit etwaiger Übermittlungen ist nicht gewährleistet.

11.2 OffBlock GmbH erhebt, nutzt und verarbeitet personenbezogenen Daten des Nutzers im Rahmen der Abwicklung des Vertrages gemäß den gesetzlichen Vorschriften.

11.3 Im Übrigen gelten, nach Einwilligung des Nutzers, die Bestimmungen der Datenschutzerklärung.

12. Abtretungsverbot


12.1 Die Übertragung des Nutzerkontos ist ohne Zustimmung von OffBlock GmbH untersagt.

13. Anwendbares Recht, Erfüllungsort und Gerichtsstand


13.1 Es gilt ausschließlich deutsches Recht unter Ausschluss des UN-Kaufrechts, auch wenn der Nutzer seinen Wohn- oder Unternehmenssitz im Ausland hat. Erfüllungsort der Leistungen ist Crailsheim.

13.2 Für sämtliche gegenwärtigen und zukünftigen Ansprüche aus oder aufgrund der Geschäftsverbindung mit Kaufleuten, juristischen Personen des öffentlichen Rechts oder öffentlich rechtlichen Sondervermögen ist ausschließlicher Gerichtsstand Crailsheim. Der gleiche Gerichtsstand gilt, wenn der Nutzer keinen allgemeinen Gerichtsstand im Inland hat, nach Vertragsabschluss seinen Wohnsitz oder gewöhnlichen Aufenthaltsort aus dem Inland verlegt oder sein Wohnsitz oder gewöhnlicher Aufenthaltsort zum Zeitpunkt der Klageerhebung nicht bekannt ist. Zwingende Bestimmungen der EuGVVO bleiben unberührt.
